Mediation is a process whereby parties to a dispute voluntarily engage the services of a neutral third party (a mediator) to facilitate communication in order to achieve a mutually acceptable resolution.
Mediation has a success rate of approximately 80%. It is a confidential process entered into between parties in which a mediator actively assists the parties in working towards a negotiated agreement. Unlike in the Court arena, the parties retain ultimate control of the decision to settle and the terms of resolution.
